Defective Product FAQ’s

Defective Products Information from Our Kansas City Product Liability Attorneys

When consumers make a purchase—whether it’s a tool or a children’s toy—they trust that the product will not only work properly, but be manufactured, designed, and distributed with the proper safeguards. Unfortunately, many people find themselves the victims of defective products every day. A very broad range of products and product-related injuries are taken up in defective product claims, and such cases can be difficult to prove. If you or a loved one is the victim of a product defect, our dedicated team of product liability attorneys can help you make a successful claim against faulty products and their manufacturers.

Frequently Asked Questions: Product Liability

What does product liability mean?

The term “product liability” refers to the responsibility of the designer, manufacturer, and/or seller of a product should anything harmful happen to the consumer as a result of using the product. If a product is defective, unreasonably dangerous, or has inadequate warnings that result in injury or death to a consumer, one or all of these groups can be taken to court for the consequent damages. The product liability attorneys at our firm have more than 15 years of experience handling these types of claims, and we can help victims and their families obtain the compensation they need to restore health, security, and quality of life.

My husband was hurt by a flawed power saw. Since it’s a dangerous tool to begin with, do we even have a case?

Yes; if you or a loved one was injured by a defective device, even if it is a dangerous product such as a power tool or sharp kitchen knife, you might still have a product liability case against the designer, manufacturer, or retailer.

If you or your loved one were using the device in an appropriate manner—in other words, as an “ordinary consumer” would use it—and were consequently injured, the fault lies not with you but with the creator, maker, or distributor of the device. At our firm serving Missouri and Kansas, the product liability attorneys have extensive training in both law and medicine. We understand the long-term consequences of serious personal injury resulting from defective products, and we will work to obtain the compensation you need to restore your quality of life.

If I was injured by a defective product last year, is it too late to file a product liability claim?

Not necessarily; if you only just discovered that you were the victim of a defective product, you might still have a case. Although the statute of limitations (the amount of time that can pass before the claim is defunct) on product liability cases can vary from state to state, it is common for many jurisdictions to have some kind of “delayed discovery” regulation to protect people’s right to bring a case when they have been seriously injured.

For the benefit of your case, we encourage you to seek legal aid from our experienced Kansas City product liability attorneys as soon as possible after being injured by a defective product to maximize your chances of receiving justice and recovering damages for your physical, emotional, and financial losses.

What will my attorney need to establish my product liability case?

As the prosecuting party, you and your legal team are responsible for bringing a burden of proof against the defendant—in this case, the designer, manufacturer, or distributor of the defective product. Your product liability attorney will need as much evidence of the injury and the product’s flaws as possible in order to successfully prove your claim in court.

We recommend making photographic documentation of both the injury and the product, as well as the having the actual product itself, if possible. Also, medical records, user instructions that came with the product, and information about the retailer are essential in such cases.

Cullan & Cullan, serving Missouri and Kansas, is prepared to assist you in your fight for justice.
