Kansas City Product Liability Attorneys

If you believe you have been using a defective drug or are suffering serious side effects, it is important to contact your doctor as soon as possible. It is also important to talk to an attorney about your legal options. If you suffered injury or harm as a result of taking a defective drug, you can pursue compensation for your losses by filing a product liability claim against the drug manufacturer. Successful civil litigation against a drug manufacturer can result in financial support for your medical bills, lost wages, suffering, and other related damages.

There are several steps you can take to protect your rights and maximize your chances of a successful claims process:

  • Keep a journal of your day-to-day struggles since being hurt.
  • Document your losses, including medical bills and time away from work.
  • Contact Cullan & Cullan to speak with a knowledgeable Kansas City drug injury lawyer.

Fighting against a large pharmaceutical company may be an uphill task, but it can be accomplished with the right type of counsel and guidance. Call (816) 861-7600 to see how we can help you.

What Is a Defective Drug?

A defective drug is a prescription or over-the-counter medication that has dangerous or serious side effects. Large corporations that dominate the pharmaceutical industry repeatedly put profits over people and put consumers at risk by selling drugs and medical devices that have not been properly tested. As a result, consumers who use these drugs to feel better end up suffering severe, life-changing physical side effects, such as organ damage or internal bleeding.

What Are the Side Effects of Dangerous Drugs?

Almost all drugs have some type of side effect. It is the responsibility of drug manufacturers to test their products and to warn consumers about the potential side effects. This helps consumers discuss the risks and benefits of the specific drug with their physicians and make an informed decision regarding the course of their treatment.

Mild side effects may include dry mouth or upset stomach, however, examples of serious, long-term side effects from defective drugs include:

  • Heart problems
  • Stroke
  • Blood clots
  • Liver damage
  • Kidney failure
  • Depression
  • Suicidal thoughts
  • Death
  • Ligament damage
  • Brain injury
  • Central nervous system damage

If you or someone you love suffered serious side effects from any type of medication, do not hesitate to involve a Kansas City injury attorney at our firm. We are here to offer the guidance you need so you can make the right choices about your case, hold the at-fault party responsible, and recover maximum compensation.

Who Protects Consumers from Defective & Dangerous Drugs?

The Center for Drug Evaluation and Research is a department within the Federal Drug Administration (FDA) that reviews testing results and other facts submitted by drug manufacturers. They do not actually test drugs, but they rely on the information that is submitted by the pharmaceutical companies. This flawed approval process often permits dangerous drugs to enter the marketplace. The FDA does, however, have the power to recall a drug that causes harm to consumers.

Our firm can offer knowledgeable insight regarding any of the following dangerous drugs, and many others:

  • Actos
  • Zoloft, Prozac, Effexor, and other SSRIs
  • Topamax
  • YAZ/Yazmin
  • Paxil
  • Fosamax
  • Pradaxa
  • Zofran
  • Risperdal
  • Zostravax
  • Xarelto

What Causes Tarkive Dyskensia?

Tardive Dyskensia (TD) is a rare disorder that is caused by certain dopamine receptor blocking drugs known as neuroleptics. Typically, TD is caused by long-term use of these drugs. Only some individuals develop TD after long-term use, while others do not. The reason for this is unknown.

Symptoms of TD include involuntary jaw, tongue, and lip movements. These movements are generally abnormal or spastic in nature and can include sticking out the tongue, jaw and facial twitching, grimacing, sucking, and other similar, jerky movements. TD can also affect the limbs and may include fast, jerky motions or slow, twisting motions of the torso and/or neck.
