If a physician’s failure to diagnose a condition is the result of negligence, then the patient has the right to hold that physician responsible. Examples of situations where a doctor’s failure to diagnose was the result of negligence include:

  • Not performing the standard diagnostic tests;
  • Misreading the results of diagnostic tests;
  • Failing to consider all possible conditions;
  • Failing to consider patient medical history;
  • Improperly conducting tests; and
  • Failing to inform the patient of diagnosis.
