Auto Accident Lawyers in Phoenix, AZ

It is no secret that texting and driving results in catastrophic car accidents, hundreds of severe injuries, and deaths. Many people do not realize how prevalent texting and driving is across America. In Arizona alone, drivers talking or using electronic devices—both hands-free and hand-held—caused 2,212 accidents in 2015. Most drivers are aware of the risks of texting and driving, but they do it anyway.

These drivers are reckless and negligent, and their thoughtlessness can lead to devastating circumstances for accident victims. Have you been injured in an accident caused by a driver who was texting? Talk to a Phoenix auto accident lawyer at Cullan & Cullan about your right to compensation. With legal and medical degrees, as well as advanced accident reconstruction training, we are positioned to deliver real results.

Arizona Cell Phone Laws

As of today, there is no law in Arizona banning the use of cell phones (either talking or texting) while driving. Measures introduced to state legislature have not passed, although a few city ordinances have. In Phoenix, for example, there is a $100 fine for texting and driving—or $250 if it causes an accident.

Tucson, Flagstaff, and Tempe have also passed laws addressing driving and cell phone use. While these laws are a step in the right direction, they fall short of where they should be. Even though there are no statewide laws banning the activity, victims of distracted driving accidents can still file a claim of negligence against drivers who text and drive.

A skilled Phoenix car accident attorney can prove negligence by:

  • Investigating the accident
  • Gathering official police reports
  • Reviewing video footage of the accident
  • Accessing the driver’s phone records

Get Compensation for Your Injuries

When drivers do not pay attention to the road, terrible accidents happen. Across the nation, texting and driving results in an average of 330,000 auto accidents with severe injuries every year. Common injuries range from broken bones and paralysis to traumatic brain injury and permanent brain damage. Distracted drivers often fail to hit their brakes or swerve to avoid a collision before impact, increasing the severity of these accidents. If you’ve sustained an injury or know someone who died because of a distracted driver, you have rights.

Nobody has the power to take a texting and driving accident back. If there are still reckless, negligent drivers on the road, we will unfortunately always have distracted driving accidents.
