Birth Defects & Zofran

Zofran was approved by the Food and Drug Administration (FDA) in 1991. Ondansetron, its generic counterpart, was approved in 2006. Initially created to fight severe nausea and vomiting related to chemotherapy, surgery, and radiation therapy, and approved by the FDA exclusively for these uses, Zofran was nonetheless marketed for off-label purposes and became the most-prescribed drug to fight nausea in pregnant women suffering from severe morning sickness.

Since that time, Zofran has been linked to serious birth defects, including:

  • Cleft palate
  • Kidney defects
  • Heart defects
  • Musculoskeletal abnormalities
  • Decreased birth weight
  • Jaundice
  • Hearing loss
  • Vision problems
  • Abnormal maternal blood pressure

If you took Zofran while pregnant and suffered any side effects, or your child was born with a birth defect, do not wait to talk to a Phoenix injury attorney at Cullan & Cullan. We can advise you of your rights and can determine whether you may have a valid claim. If so, you may be entitled to financial compensation for all losses and expenses related to Zofran side effects, including your child’s lifelong care, if necessary.

Zofran Was Wrongly Promoted for Off-Label Use

In 2012, Zofran manufacturer GlaxoSmithKline pled guilty to criminal charges related to its off-label marketing of the popular antiemetic (a drug used to treat nausea and vomiting). This included marketing Zofran for uses that were not approved by the FDA, as well as making false claims regarding the safety and workability of the drug. Further, the settlement included claims that GlaxoSmithKline had illegally offered and paid money to healthcare professionals to get them to promote and prescribe Zofran to their patients.

Conduct like this puts patients across the U.S. in grave danger. In this case, it was pregnant women and their unborn children. Our Phoenix Zofran lawsuit attorneys are dedicated to righting this wrong to the fullest possible extent. To find out how we can help you, please contact our offices for a free consultation. We handle all drug injury claims on a contingency basis, so we only get paid if you do.
