Types of Medical Device Defects
One issue that makes medical devices more prone to cause harm is the less-than-stringent Food and Drug Administration (FDA) approval process that applies to these products. Unlike drugs that require clinical trials and testing before approval, medical devices may be approved if they are “substantially similar” to another product that already has FDA approval. This leaves the door open for new, untested products to be released.
A lawsuit for a defective medical device may be based on one or more of the following types of defects:
- A manufacturing defect resulting from a device that was not assembled or manufactured correctly.
- A design defect that affects the innate workability and safety of the device, regardless of whether it is manufactured according to its specs.
- Misleading or inappropriate marketing, or a device that is released without sufficient warnings for use.
