$11.5 Million Birth Injury Settlement

Nebraska attorneys Joseph Cullan and Patrick Cullan of Cullan & Cullan won a substantial settlement for an Omaha couple whose baby suffered major birth injuries during delivery at Nebraska Methodist Hospital and Physicians Clinic in 2010.

In a trial that lasted a little over two weeks, Patrick Cullan argued that “the delivery was grossly mismanaged by the midwife and doctor. Breathing problems were left unattended and the child’s health deteriorated during the delivery.” In addition, forceps were improperly used, resulting in severe brain damage to the newborn who is now six and will require a lifetime of care.

The couple would rather have a healthy son but are grateful for the settlement, which will help ease the financial burden of their child’s future care.
