Frequently Asked Questions: Semi-Truck Accidents

What are the most common causes of large truck accidents?

There are many common causes of semi-truck accidents. Due to their size, semi trucks cannot accelerate, brake, slow down or stop as quickly as a smaller, lighter vehicle. Common causes for serious semi truck accidents are:

  • Lack of training on the part of the truck driver
  • Overloaded or oversized trucks
  • Poorly maintained truck brakes
  • Poor driving conditions (fog, snow, rain, or smoke)
  • Fatigued driver
  • Speeding
  • Aggressive driving behavior
  • Failure to yield the right of way
  • Truck drivers driving under the influence of drugs and alcohol
  • Dangerous or reckless truck driver
  • Inadequate safety systems, reflectors, lights, and other warning devices
  • Failure of truck to install an under-ride protection under-guard

I was injured in a truck crash where a semi truck jackknifed. Does this mean the truck driver was negligent?

Jackknifing refers to the accidental folding of a large truck (so it resembles the acute angle of a folding pocket knife). If a vehicle towing a trailer skids, the trailer could push it from behind until it spins round and faces backwards. Semi truck jackknifing may be caused by equipment failure, improper braking, or negative road conditions, such as a wet road surface. In many cases jackknifing will cause a rollover.

Often a truck jackknifes because of the truck driver’s negligence because the driver locked up the trucks breaks. Because a semi truck driver could theoretically jackknife without driver error, however, our Kansas City semi truck accident attorneys will have to prove driver negligence. The defense attorneys are likely to seek to avoid liability by arguing that the truck jackknifed due to unforeseeable road conditions or because it had to take an emergency turn to avoid another vehicle. At Cullan & Cullan, our semi truck accident attorneys can help fully investigate the physical evidence to determine the cause of the wreck.
