Cullan & Cullan Named Among Top 20 Medical Malpractice Verdicts in US for 2022

K.H., Pro Ami v. Sandri was handled by Joe Cullan, M.D., J.D., Sam Cullan, M.D., J.D., and Pat Cullan M.D., J.D. with a $25,374,555.00 verdict that was rendered in Missouri. According to TopVerdict’s research, this result was the 18th-largest medical malpractice verdict achieved anywhere in the country in 2022.
In the case, our attorney-doctors represented a little girl who suffered a birth injury due to the excessive use of Pitocin (oxytocin) during delivery. The overuse of the drug, which can help induce labor, caused the newborn to suffer a brain injury and cerebral palsy (CP). The defendants lawyers attempted to argue that the brain injury happened in utero and downplayed the severity of its consequences.
Cullan & Cullan took the matter to court. A two-week trial was conducted before a judge and jury. The jury found that the child’s brain injury could have been prevented if Pitocin had been administrated at acceptable, safe levels and if the doctors and nurses should have properly monitored the baby in utero. The $25.37 million verdict is comprised of about $19 million in future medical damages, $1.4 million in future non-medical economic damages, and $5 million in past and future non-economic damages.
